Question écrite de M. Wyngaard relative aux marchés publics de fourniture de livres et autres
publications aux bibliothèques communales.
- Pourriez-vous m’indiquer le(s) marché(s) qui est/sont lancé(s) annuellement ou pour plusieurs années
concernant la fourniture de livres et autres publications aux bibliothèques communales ? S’agit-il d’un
marché unique ou de marchés distincts (livres scolaires, BD, livres pour enfants…) ? Par ailleurs, quelle est la
procédure suivie (procédure négociée, appel d’offres, adjudication) ? Celle-ci est-elle imposée/suggérée par
la Communauté française ? Enfin, quels sont les montants concernés ?
- Pourriez-vous également m’indiquer, pour les 10 dernières années, les libraires qui ont été consultés et
ceux qui ont soumissionné dans le cadre de ces différents marchés publics ?

Réponse :
Jusqu'en 2017, le service de la Culture commandait chaque année les livres et bandes-dessinées jeunesse et
adulte via deux marchés publics : un pour les bibliothèques francophones et l'autre pour la bibliothèque
néerlandophone. Le mode de passation des marchés est déterminé en fonction des montants de ceux-ci,
conformément à la législation (appel d'offre général avec publication au bulletin des adjudications ou marché
par procédure négociée sans publicité). Chaque marché est divisé en plusieurs lots en fonction du type
d'ouvrage commandé (livres adultes, livres jeunesse, BD, livres en langues étrangères, …).
Chaque année, pour les bibliothèques francophones, un budget est alloué à l'achat de livres d'occasion ou à
prix réduits. Ces achats ne font pas partie du marché dans la mesure où il s'agit d'opportunités.
En ce qui concerne les revues, celles-ci ne font pas l'objet d'un marché public dans la mesure où un seul
fournisseur ne pourrait répondre à un appel d'offre vu la très grande diversité des revues commandées.
Depuis le début 2017, en ce qui concerne l'achat de livres et bandes-dessinées pour les bibliothèques
francophones, notre administration a décidé de participer au marché public d'achat de livres initié par la
Fédération Wallonie-Bruxelles. En effet, le Service général des Lettres et du Livre et service général de
l’Action territoriale de la Fédération Wallonie-Bruxelles a proposé aux communes de participer à un marché
public de fourniture, sous forme de centrale de marché, portant sur l’achat de livres papier et sur l’accès à
des livres numériques pour une durée de quatre ans. Nous avons reçu une liste des librairies désignées et
nous sommes libres de passer commande dans les différents établissements sans limite d’aucune sorte et
selon les nécessités du moment.
Si cette façon de fonctionner devait poser problèmes, notre adhésion à ce marché n'est pas contraignante et
nous pourrions passer un marché en parallèle.
