Artic% 7, paragraphe 1, de la Convention : Contrairement à l'article 15, paragraphe 1, derniére phrase, du Pacte des Nations Unies relatif aux droits civils et politiques, l'article 7 de la Convention ne garantit aucun droit 9/âpplication de la toi pénale plus favorable en cas de modification postérieure à la commission de l'infraction . (English : see p . 71 ) Résumé des faits pe rtinents En avril 1975, l'administration fiscale a prononcé contre le requérant une amende de 500 DM pour avoir exercé une activité de conseiller fiscal sans avoir les qualifications exigées par l'article 107 ( a) du code des impôts (Abgabeordnung) . Le requérant a fait aussitôt opposition . En juin 1975, l'article 107 (a) a été abrogé avec effet au 1 - juillet 1975. Néanmoins, le tribunal d'instance tAmtsgericht) a confirmé l'amende en 1976. EN DROIT IExtrait l Le requérant se plaint (encore) d'avoir été condamné par le tribunal d'instance, bien qu'une loi, entrée en vigueur depuis son opposition à l'amend e - 70 - administrative, ait autorisé une partie des actes de conseil fiscal qu'il lui était reproché d'avoir accomplis sans avoir les qualifications requises . Il allégue à cet égard la violation de l'article 7 de la Convention et se référe à l'article 15 du Pacte des Nations Unies relatif aux droits civils et politiques . Toutefois, l'article 7 de la Convention ne contient aucune disposition semblable à l'article 15, paragraphe 1 in fine du Pacte des Nations Unies, qui vise d'ailleurs une hypothése différente en garantissant au délinquant le droit de bénéficier de l'application d'une peine plus légère prévue par une loi postérieure à l'infraction . En l'espéce, une partie des faits mis à charge du requérant ont fait, en quelque sorte, l'objet d'une décriminalisation . Il n'en reste pas moins, qu'au moment o0 elle a été commise, l'action du requérant constituait une infraction d'aprés le droit national au sens de l'article 7, paragraphe 1, en sorte que le grief est (aussi) manifestement mal fondé au sens de l'article 27, paragraphe 2 . Summary of the relevant facts In April 1975, the tax authorities imposed a fine of 50 7 DM on the applicant for having exercised rhe profession of a chartered accounted without having obtained the qualifications required by secrion 107 (a) of the Fiscal Code IAbgabeordnungl . The applicant immediarely appealed . In June 7975 Section 107 (a) was repealed with effecr from 1 July 1975. Nevertheless in 1976 the Magrstrate's Courr (Amtsgericht) rejected the applicant's appeal against the fine . 1 TRANSLA T/ON I THE LAW (Extract ) The applicant complains that the Magistrate's Court upheld the imposition of an administrative fine even though, after he had appealed against it, an act had entered into force which authorised in part the activities which he was accused of having carried out as a chartered accountant without having the requisite qualifications . He alleges in this respect a violation of Article 7 of the Convention and refers to Article 15 of the United Nations Covenant on Civil and Politica l - 71 - Rights . However, Article 7 of the Convention does not contain a provision similar to Article 15, paragraph 1 in fine of the United Nations Covenant which is, moreover, based on a different hypothesis because it guarantees the convicted person the right to benefit from the application of a lighter penalty imposed by a law enacted subsequent to the commission of the offence . In the present case some of the charges against the applicant are to a certain exteni no longer criminal offences . Nevertheless, at the time that the offence was committed the action of the applicant constituted a crime according to national law within the meaning of Article 7, paragraph 1 , so that this complaint is (also) manifestly ill-founded within the meaning of Article 27, paragraph 2 . _72_
